I mean nobody with the insanity defense gets out scot-free. almost all of them have to spend their lives in horrible state mental institutions that are arguably worse than prison. people pleading temporary insanity get out scot-free, however

In most jurisdictions the defendant has to prove they were insane at the time the crime occurred. Massachusetts is an outlier. Regardless, a defendant should be able to claim they were insane at the time of the killing, because a legally insane person can not morally be culpable for their actions. Legally insane means that they didn’t know what they were doing because of a mental defect. Theres no point in sending someone who didn’t know or have control of their actions to prison. It’s just cruel.

it's kind of funny (sad funny) to watch people act like Kevin Redington invented the insanity defense, as if it hasn't existed since ancient Greek and Roman law, and probably before that too

Stop fence sitting man. She planned the killing of those 3 kids and after killing them was thinking of what to do before her husband got home so she clearly had enough conscious to know what she was doing. Even if see somehow had a psychosis and wasnt there she needs to be sent to a psychiatric prison. She needs help AND prison.
