Red wanted to do bifurcation of the case, to first do not guilty at all (did not commit the crime) and second part is for sanity if the jury somehow will find her guilty of a crime. judge denied. That is why we can see that he does hybrid defence.

They filed a notice during pretrial hearings for a lack of criminal responsibility defense. It’s the exact same thing as NGRI in other states. They’re not disputing that she killed the children. Reddington has said this throughout the entire trial. The jury did not decide that. It was more than likely 11 jurors were NGRI and the 1 was guilty. But no one knows for sure

Because if she pled guilty she would’ve gone to jail for life & they are trying to avoid that with the lack of criminal responsibility (NGRI). She can’t plead guilty & go to a mental facility where she can’t be out in a few years. The option for her serving the least amount of time is NGRI.

Have you see the pre trial video it says 3 times she isn’t guilty. They had to say it after the pre trial to be able to fight for her innocence

You can only plead guilty or not guilty. And you have to plead not guilty to apply the LCR defense.

By the time she jumped out the drugs she took prior wouldn’t be in full effect. And those who jump to kill themselves don’t put their arms out to break the fall. She wouldn’t be affected that much by the drugs - which were all at therapeutic levels other than the Seroquel which was slightly elevated so she didn’t take that much to be a limp ragdoll.
