@lawyerohenewaaadvocacy: Under Ghana’s Children’s Act, 1998 (Act 560), a father’s responsibility towards his child is a continuing legal responsibility. It does not end merely because the parents separate, divorce, or the child lives with the mother. A father’s responsibilities include: MAINTENANCE: He has a duty to contribute to the child’s maintenance and provide necessities such as health care, education and reasonable shelter. CARE AND GUIDANCE: He has a responsibility to provide guidance, care and assistance. Protection: He must protect the child from neglect, discrimination, violence, abuse and other physical or moral hazards. SURVIVAL AND DEVELOPMENT: He has a responsibility to contribute to the child’s survival and proper development. WELFARE: He must not deprive the child of his or her welfare simply because he is no longer living with the mother. Importantly, section 6 of Act 560 does not make these responsibilities conditional on the parents remaining married or living together. So, in principle: A father does not cease to be a father because the marriage has ended. Divorce ends the marital relationship; it does not end parental responsibility.
