This trial has exhibited that a vast majority of Americans have zero understanding of how our legal system works. That's terrifying. I've had to explain reasonable doubt to more people than I care to admit.

I try to explain to them like this. I claim I am not guilty, but if you find me guilty, please consider me as insane. if only they know how difficult and how much skill it takes to walk that thin line for this defense, they'd appreciate Reddington's masterful execution.

I’ve had people argue with me that the presumption of innocence doesn’t exist and suggest the defense’s job is to prove their client’s innocence so I’m not surprised at all people are confused that there were two separate legal issues. We are doomed. People need to get more comfortable not expressing an opinion about something they know absolutely nothing about.

Oh my goodness trying explain this has been so painful!! people literally fight with me and call me names when I am trying to calmly explain that not guilty was an option! That the prosecution had burden of proof in proving the homicide and criminal responsibility!

this makes sense!! i'm trying to understand this so i can explain it to people when they say she admitted it lol. but my question is, why did lindsay lay out the details of how the act was done? like the order of the children etc. is her admitted those details part of the strategy? genuinely trying to understand so i appreciate any clarification!

Or how many throw up the temperature testimonials from both sides. Doctors make educated opinions daily. Many are misdiagnoses on simple things. So common chances are youve been misdiagnosed. Doctora are human. The prosecutors witness obviously worked for prosecution. And the defense was not educated enough on that specific topic bc they were not aware of the science that made it impossible. They dont know everything. Just bc its said in court, doesnt make it true or the best information.

The problem is the people who lack comprehension and critical thinking skills will still loudly and confidently say that you are wrong. There’s a word for that but I’m blanking. These people thinking PC just did his best and LC is a monster are massive red flags. I wouldn’t want them on a jury.

I agree, but I also think a lot of the “Lindsay didn’t do it crowd” refuse to understand what the purpose of the bifurcation would be. The request to have the trial bifurcated specifically came with the stipulation that Lindsay admit physical responsibility for the crime and the next phase could focus on her mental state and criminal responsibility. That is a fact. This is not something a defense attorney does if there is any credible evidence that their client is innocent of the crime. This is not the “only” route he could have taken, nor is it the easiest route. A lot of people are twisting it into something it’s not. Is that a confession? No. But does it imply her own defense team isn’t trying to argue her innocence? Yes.

The strategy involving bifurcation was to split the trial into two phases: Phase 1) did she commit the physical act (actus reus), and Phase 2) was she in her right mind (mens rea). The defense was going to formally stipulate that Lindsay undoubtedly killed her kids. This would have shortened the first phase, which would have kept the prosecution from discussing all the grisly details for too long (which could bias a jury against a "not criminally responsible" verdict).
