@profilers.notebook: Luigi Mangione was supposed to begin jury selection September 8 in his New York state murder case over the killing of UnitedHealthcare CEO Brian Thompson. That trial has now been POSTPONED INDEFINITELY. And the reason is a legal twist a lot of people probably missed. On August 14, Mangione pleaded guilty in the separate federal case to two stalking charges and admitted in court that he shot Thompson in Manhattan on December 4, 2024. Federal prosecutors say they will seek life in prison when he's sentenced December 18. ⚖️ SO WHAT HAPPENED TO THE STATE MURDER CASE? Immediately after that federal plea, Mangione's attorneys asked the New York judge to throw out the state prosecution. Their argument? DOUBLE JEOPARDY. Ordinarily, federal and state governments can separately prosecute conduct arising from the same event. But New York has broader statutory protections against successive prosecutions than the federal Constitution provides. Mangione's attorneys argue that after his federal guilty plea, prosecuting him for murder and weapons offenses based on the same underlying killing would violate those protections. The Manhattan DA disagrees and intends to fight the motion. Ultimately, the judge has not decided whether the state case will be dismissed. AND HERE'S THE CRAZY PART: Before the federal plea, the court had already made preparations for this enormous September trial including ordering an anonymous jury because of concerns about harassment, intimidation and outside influence. Jury selection was supposed to begin tomorrow. Now there will be no jury selection tomorrow. Instead: October 9 — deadline for prosecutors to respond to the dismissal motion. December 10 — next scheduled appearance in the New York state case. December 18 — federal sentencing. And Brian Thompson should not disappear from this story. He was 50 years old, a husband and father, and the CEO of UnitedHealthcare when he was killed outside a Manhattan hotel on December 4, 2024. 🧠 THE QUESTION NOW ISN'T “WILL MANGIONE BE CONVICTED?” He has already pleaded guilty federally.
