I followed the case and relayed what was happening to my husband, and we're Canadian, so I used a hockey analogy to explain the burdens of proof to my husband: The prosecution had to score on two nets 1) That she actually killed the kids, and 2) That she was "sane" when she did. And they had to score on net 1 before net 2 even really came into play. Red could only properly play goalie to one net, and so he picked net 2. That meant that net 1 was basically undefended - but the prosecution STILL had to get the puck in the net - it wasn't automatically there. But either, the prosecution was so incredibly inept or the initial investigation was so poorly done (or both) that basically every time they tried to shoot at net 1 they sent the puck back down the ice the other way. Almost everyone entered the game assuming net 1 was basically a done-deal because it was wide open, and net 2 was the only question. But the more the evidence and details came out during the case, the more obvious it became that net 1 was just not happening. And the people yelling "she confessed" and "even the defense said she did it" clearly either didn't actually follow the trial, or got confused by both nets, and thought the openness of net 1 meant that the goal was scored automatically, and never stopped to check if the prosecution actually scored (with admissible facts and evidence in the case).

the amount of people I am seeing who say she admitted it, blows my mind. You do not go to TRIAL when you plead GUILTY. If she plead guilty or admitted guilt, it would be a sentencing hearing. lol.

I’m so tired of the “but she admitted it…this was only about her sanity vs insanity” people.

I blame the news. They constantly lead with her admitting it. It drives me insane. They never mention she just plain could not have done it at all!

IT professional here. iCloud data (Messages, calls, photos, etc) could have been identical in both phones. Her Watch may have been only synced to one. I’d like to know if that was the case. Because the watch didn’t record heart rate = not being worn. Phones AND watches can both record movement data.

I think people are also making a mistake in their judgment for another reason: because Lindsay had depression/psychosis, they automatically assume that she must have committed the crime. But we absolutely cannot draw that conclusion. Psychosis does not always lead to murder.

You make me seem smart to my friends, family, and coworkers because I just parrot what you say. Haha so thanks you. I’m literally like “I was expecting the judge to utilize rule 35 part b, but he didn’t” haha

What’s crazy is that the jurors speaking about the case were making decisions based on her admitting it and therefor leaning on not guilty by insanity! Which seems absolutely crazy!! To me (ex police officer) there was not enough evidence to support her doing it! They didn’t prove she did it beyond reasonable doubt. Fact! So how can you still attribute the mental health defence?? Makes no sense!

I spoke with a friend who is a lawyer and I said if I were on the jury I would find her not guilty. and they said, you cant find her not guilty bc she has already admitted it. that its either non-guilty as reason of insanity or guilty. I cant understand how lawyers are getting this wrong as well. I watched the judge's preliminary instructions again today, and as clear as day he says to the jury that they CAN find her not guilty and the rest. most people who are confused are not actually watching the trial and getting misleading second hand info.

In all fairness, I think it also really spiraled people when Red said she killed her three children in court. It was almost like he just said it in passing. It stopped me in my tracks as well.
