If you think, “I’ve never been in trouble, I filed my paperwork, and I’m waiting for a decision, so I’m safe,” you need to understand what is happening. The Hill’s September 6, 2026 report describes immigration enforcement increasingly reaching people with no criminal record, including people with pending asylum claims or applications to adjust their status. The data cited in the report showed that 55% of those arrested had no criminal record. Another 24% had faced charges but had not been convicted. Meanwhile, ICE recorded more than 50,000 arrests in each of July and August. These numbers raise serious questions about the administration’s claim that enforcement is focused on the “worst of the worst.” The report describes arrests involving immigration check-ins, court interactions, and airports. Experts warn that people already complying with the immigration process can be easier to locate because the government already has their information. Some are being detained while they continue fighting their cases, without a final removal order. Then that same information can make them easier to find when the government wants to increase arrest numbers. Compliance should count for something. A pending case is not a blanket guarantee against arrest. Your protections depend on your individual circumstances and the type of application or proceeding involved. Know exactly what is pending, what protection it provides, and what your attorney would do if you were detained.
