The FBI has made statements to stooooopp reporting fiction. It clogs their system and takes up resources that can be used to help real victims. The FBI does not give two shits about fictional material. And you actually can get in legal trouble for false reporting, idk why people forget that.

Unfortunately, per a recent ruling, they're interpreting the law to protect AI images of children as legal even though they are trained from real images and trying to make in a 1st amendment right issue.

Ao3 also doesn't like that content and regularly removed that kind of stuff depending on the context of the story. since its real humans that need to look into the matter each time, if you a story about real kids being SAed is on there then report it. because yes even the mods find it weird and distasteful. AO3 is not perfect by any means though and you might have a mod who doesn't give a fuck, sadly. but in general they do have rules around these things. I do get that it's a "slippery slope" for censorship but I think it needs a proper discussion since there is a LOT of nuance to it. and also why minors shouldn't be in on the discussion. I know when I was a minor over 15 years ago I would not have been able to have these conversations or mentally understood it all. especially now with how much the internet has changed since then.

I find RPF so strange and weird especially when it involves children. Explicit works about actual children should be banned. Although it’s a slippery slope but if the family reaches out to Ao3 about any fics about their minor children asking for it to be taken down ao3. This only applies to RPF about minors not RPF about adults and religious figures so Trump x Lighting McQueen (idk if those are real) or Jesus x Judas fics are ok and should not be taken down

Some of the fics in there probably shouldn't exist. RPF is an extremely shaky line. It leans too much into not separating fiction and reality. However, it does exist and is, more often than not, properly tagged in a way where you HAVE to be looking for it. It's why I have an issue with the people who are against it. They only know for a fact that it exists because they looked for it. I assumed it existed and hoped that it didn't, but I never went looking to see if I was right, because it's not something I want to read or confirm its existence.

also can people pay attention to what the ACTUAL ruling about ai CSAM said, please? the reason it is technically allowed is because there are simply not enough/really any laws or regulations about generative ai at this current time. it was NOT a judge saying 'yeah ai CSAM is a-okay and everyone should do it' 🙃 so instead of misreading this ruling, maybe advocate and push for legislation regulating/banning generative ai to fix this problem!!! not you, OP, but I see people all over totally misunderstanding the situation.

I will say I think the people sending those types of fics to parents/the minors themselves who are claiming to want to spread awareness are causing just as much harm as the ones writing it. these folks don't need to know it exists. especially the families of those lost at sandy hook, c'mon man. they can't do anything about it, so it's just causing pain for no reason

the point is the stories are not about things that actually happened, and if something of that nature is to count as a crime as written form, it has to equate to evidence of a crime. fictional stories are not evidence of a crime, so to my understanding that is why it isn't illegal, and why it would be a waste of resources to pursue in just about every case on ao3 and why it's a little easier to pursue with visual depictions.

Also how are people finding out about these stories? You can’t exactly accidentally stumble upon things on ao3. Yes I know it shouldn’t exist but it’s also not exactly in your face unless you’re getting really close? It’s not perfect at all but it’s the best we have

My hot take about the things AO3 hosts that I don’t like is that at least it’s easier for me to avoid. Because I’ve started a fic on other fanfic websites that do ban that content just to be jumpscared by it. At least with it being allowed, the authors are more likely to be honest about the content within so I can exclude the tags.

RPF is protected under the first amendment unfortunately. So long as you are not claiming these are factual events you can legally write whatever you want. Again this is all LEGAL not my personal belief

I don’t think ao3 should be able to ban csam as a hole as ao3 is one of the last remaining true anti censorship websites to just ban csam as a hole and not sexualized csam or encouraged csam because csam adds to stories, and charecters and it might make you feel icky but that means it’s working it’s not supposed to make you feel good it’s supposed to be gut renchingly depressing
