They shouldn’t be able to classify a squatter in an obviously active residence. That puts the burden squarely on the homeowner or lease holder. The state can’t override home control from the current tenant. That’s ludicrous.

Restating: cases where permission to live together (partners, family) was granted without expectation of rent or a written contract, but the primary tenant now wants to remove their permission... are being treated the same as when someone breaks into an empty house. Specifically by bringing a case a certain way (even when lying), the person facing removal is denied their legal rights as a de facto tenant and denied access to legal aid to disprove the lie. A process meant for one narrow case is now being misapplied to a broader case. Tenants with leases are unaffected, but victims of DV and abuse are disproportionately likely to not be on a lease, so are especially vulnerable to this type of power game by an abuser.
