His defense filed a motion to suppress the evidence—essentially arguing that the government’s acquisition of the guns was unlawful. 3. The trial court granted the motion, which resulted in the charges being dismissed because the prosecution could no longer use the critical firearm evidence. 4. The prosecutor appealed that ruling. 5. The New Jersey Appellate Division upheld Flynn’s victory. 6. The matter ultimately went to the New Jersey Supreme Court, where Flynn again prevailed. 7. The charges were ultimately dismissed, and the record was subsequently expunged, according to the account presented in the SWU interview.

ladies and gentlemen that's a living person on the screen. dozens of cops, guns drawn, handcuffed, taken to jail, NO BAD TREATMENT, THEY WERE NICE TO HIM, in a matter involving guns. he's alive and well. a little shaken, discombobulated but alive.
