The jury foreperson said: “We weren’t trying to figure out if she murdered the children. She did, and she’s admitting that.” But that is NOT what the judge instructed them to do. The Commonwealth still had the burden of proving beyond a reasonable doubt that Lindsay committed the crimes. The jury was supposed to determine whether the prosecution proved the elements of the crimes FIRST, and only then consider criminal responsibility. According to the foreperson herself, they skipped that first question because they treated Lindsay’s alleged “admission” as proof. Lindsay pleaded NOT GUILTY. So while they accuse the holdout juror of not following the judge’s instructions, her own words suggest that the other 11 didn’t fully follow them either.

Thank God I’m not the only one? My jaw was on the floor for an hour. Did they go into that jury room just assuming she did it because I thought the instructions from the judge was that they first must prove beyond Reasonable Doubt that she did the crimes with the evidence provided!

I blame the judge. They didn’t even understand the assignment. There is a 4th juror out there saying that the DA didn’t even prove she did it one way or the other, but they felt the best way to provide justice was for NGRI. This case should have been bifurcated. I understand there isn’t precedent in Mass, but the judge should have set it because this case is the perfect example of a case that needed it.

Context - Australian non-practicing lawyer here obsessed with this case. Blown away by some of Red’s “she killed the kids” comments during the trial. Absolutely gobsmacked by Rosemary’s comments immediately after the trial, especially in the face of so much reasonable doubt. My working theory is that the defence did not evolve along with the evidence. She was told she did it, she believed she did it, those were Red’s instructions, he fought a NGRI defence, and both he and Rosemary never stopped to consider what if she didn’t do it. What if she didn’t know she didn’t do it. Red was a little too focused on “smashing” the prosecutors in my view. It always comes down to male ego right? And this woman, who has lost everything, gets screwed again. Her vulnerability gets exploited again. It is an absolute travesty and my heart breaks for her.
