@thelegalqueen: Think divorce means you simply split everything 50-50? That’s not actually how it works.

Hmm. Sometimes there’s not enough money in the matrimonial pot to waste it on legal fees, trying to fight for more.

Not everyone can afford legal advice / mediation, or is eligible for legal aid. There’s a massive community of us who have no choice but to LIP and it’s sad that in 2026, the system doesn’t lend itself to allow us to navigate this without the expectation of needing a degree in family law - and ultimately end up worse off through no fault of our own.

I don't want anything from him I just want a clean break order. Can I do this without the judge rejecting it? His circumstances are a lot better than mine and we have a child.

I've not been financially in a position to get advice (he has had advice though) and ours has been rejected several times and been dragging on for years. So if you can find the money please get legal advice, it will save you in the long run

Of course there is a simpler way. My ex (I say ex no divorce, separated 7 years now) & I look out for each other. I bought a house for & our remaining 3 children, so she didn’t have to concern herself over rent/mortgage. Paid for a loft conversion & sold it on. The profits were then put into another house to be developed & flipped. Now we both own our own homes outright & have property for the children when they feel the time is right. Divorce/separation doesn’t have to create enemies, it just shifts things a little.

What if we have been separated for 8 years, we don’t own anything together never have, no kids together nothing ever in both our names, I don’t want anything from him and he doesn’t want anything from me, is it easy to do without a solicitor?

Better then to either divide the assets yourself and/or make no financial claim if the judge gets the final say! Yes your ex can still make a claim years later but then you can be run over by a bus before then

my ex wife walked away and she took nothing as she was with a wealthy partner, who married as soon as the divorcecame through. my solicitor advised me not to have a financial order as she said a judge probably would not except me having everything. was this the correct thing to do? I've never remarried.

A quick 50:50 split isn’t 💰 beneficial for solicitors 🙄🤣 the one positive thing about the future of AI is that solicitors will ultimately become unnecessary as case law and historic precedence will be automatically applied. Avoiding the situation in the first place is better than rectifying the situation.

I had a 50/50 split, agreed from the start that's what we would do. So kept to our word it's not the solicitors choice or the courts choice if you both agree.
