Just think about all the juries that may have reached the wrong verdict simply because the jurors didn’t understand the law well enough. Shouldn’t that raise questions about all the convictions that have been based on jury verdicts? Taken to its logical conclusion, perhaps everyone who has been sent to prison following a jury verdict should be entitled to a retrial. People are essentially expected to make decisions that can have enormous consequences for another person’s life, while not necessarily having the legal knowledge required to properly understand the law or how it should be applied. If this really is a fundamental weakness in the system, then it’s a serious problem for the United States. But ultimately, this is a system you have chosen to maintain. The U.S. continues to rely heavily on juries, even though many other countries have reduced their use of juries—or moved away from certain forms of jury trials altogether—precisely because of the system’s obvious flaws and the risk of wrongful decisions.
