kiffins silence wasn't kiffins choice. his attorneys told him to stfu after the SEC amended the lawsuit they filed against LSU for the halftime comments he made. this is rule #1 when facing a lawsuit and his attorneys reminded him of that.

how long has it been a rule that when you declare for the draft you automatically lose any remaining eligibility? that has been a ncaa rule for a very long time. whether they made an NFL roster or not they declared for the draft and forfeited remaining eligibility.
