@ny_divorce_lawyer: #SpousalSupport is the source of a lot of conflict during divorce negotiations. It can lead to litigation if parties expectations do not match the real reality. Spousal support runs out after a while and sometimes the best advice is to be financially independent. #divorce. #DivorceAdvice #NewYorkDivorceAttorney.
My mom’s parting words to me in my gown and veil before walking down the aisle “have money he doesn’t know about. Every smart woman does.” (She was never the sentimental romantic type 😂) 3 years later I (a nurse practitioner) paid my ex husband (an attorney!) alimony. Her words at that time were to make sure I let any woman I ever met that he dated know he took the money 😭

The thing I don’t hear being addressed is the wage gap and other forms of gendered inequity. The anger that drives women in these situations is structurally different than men

I honestly think even the term “spousal support” creates the wrong picture in cases like mine. If it were truly “spousal support,” where was that support while I was actually the spouse? I see temporary maintenance much more as transition support. One spouse may leave the marriage with years of income growth, work history and financial independence, while the other leaves having provided pregnancy, childbirth, childcare and unpaid household labor, sometimes after years in which she was not supported in building her own financial independence. Then the marriage ends and she is expected to start from below zero entirely at her own expense. If the law is meant to address the economic consequences of the marriage, why shouldn’t the spouse who materially contributed to creating that imbalance share the cost of correcting it? Independence should absolutely be the goal. But the transition to independence should not be treated as solely the responsibility of the spouse who already absorbed the lost earning years. Calling it “support” makes it sound like a favor; in many cases, it is really a temporary allocation of the financial consequences both spouses helped create.

Paying spousal support as a woman and also being the one creating children, taking care of the home, doing most of the labor emotionally, mentally, etc is insane 💀💀.

Thank you for sharing your expertise. A common question that I keep coming back to is why get married. Yes, as society becomes more egalitarian and women earn more and pay more, many of those old tropes and expectations still permeate society and court rooms. Men still pay. The ONLY way to win this game is not play.

I’m confused. Why would anyone have to council their client to get a job unless they were intentionally not seeking Employment in order to enrich themselves during the divorce settlement?

Own a small business personal profit of less than 100k husband voluntarily underemployed was a building superintendent building track homes for first 15 yrs out of 30 yr marriage very successful now he wants 3500 a month and all assets worth 150k including home he can’t qualify for so it’ll be sold. He only makes 20 an hour as maintenance man. I have continued to pay ALL of his living expenses since I moved out he pockets all his paycheck. He stole money out of my business and then claimed to the court I took money from him because I demanded he start paying for his utilities. House is only in my name so I have a 3k mortgage and now my own living expenses. Any advice?

What about the men who bust there has so the women can stay home to raise the kids. It seems Ike you put a twist like men didn't sacrifice their time for money to allow the family life style both discussed prior to kids. 🤔🤔🤔
