you are 💯 correct. People think just because someone is here illegally all of the due process gets thrown away. which is incorrect and to be exact being the in the USA illegally is just a civil violation not a felony or criminal offense

I think what people miss is that “due process” is not one specific thing. Criminal and civil due process have certain important distinctions. When people hear “due process” they immediately think of what they see on Law and Order, when that’s just not true in civil cases. The bar is far higher in criminal court.
