Husband: Both of us. The wife shook her head. Wife: It gave him certainty. I just didn’t understand what $1 million would mean twenty-two years later. Judge: What do you mean? Judge: Then I don’t have a basis, on these facts, to simply replace the agreement with one you wish you had negotiated. The wife looked stunned. Wife: So after twenty-two years, I’m still bound by a number we chose when we were 29?Judge: If the agreement is enforceable under the applicable law, yes. The judge paused. Judge: That’s precisely why people are advised to think carefully about fixed-dollar provisions in long-term marriages. The $1 million provision was enforced. The husband kept the additional wealth protected by the prenup. And the wife walked away knowing that the number she’d once considered enormous was now a tiny fraction of the fortune her husband had built.
What if despite his best efforts his business took an unforeseen financial downturn. And he paid for everything for the wife and kids his entire life. And at time of divorce he had $1.2m. Would the husband be able to renegotiate a fixed $1m settlement? You can’t have it both ways.

Prenup is based on mistrust. It’s not the poorly written or conceived agreement that’s the problem. The problem is a fundamental mistrust between two people that are vowing to stick together thru life’s ups and downs while at the exact same time saying if we decide down the road to break our vows for life here is how the money is going to be divided up. Why bother getting married before God and family if you fundamentally don’t trust each other. I’m keeping the money we created together as a couple and you get the prenup $ is so dishonorable, but maybe not for people with a prenup.

At the end of the day, if he was a decent man he would have voluntarily gave her more regardless of what was agreed upon. She took care of their home & children while he worked. That has value.

A prenup should only be set up to protect pre martial assets. Anything earned from either spouse during the marriage legally would be split equally but they had the prenup. Sounds like he is the greedy one and her legal counsel wasn't thinking with foresight.

The judge should have taken into account that without his wife doing everything at home helping him in so many other ways that the husband probably would not have been so successful without her so she actually was making the money as well so she should have received half of what he made over the years!!
