@eddymotovibes: Under Uganda’s succession laws, the mere fact that a person has made a will does not mean that every provision contained in that will will automatically be recognised or enforced by a court. A will must comply with the legal requirements governing its validity, including the requirements relating to its execution and witnessing. Furthermore, certain provisions in a will may be subject to legal limitations and public policy. It is also important to distinguish between personal property and a traditional or cultural institution such as the throne of the Tooro Kingdom. The position of an heir to the throne is not necessarily equivalent to an ordinary beneficiary inheriting the personal property of the deceased. The throne is an institution serving the people of Tooro and its succession may be governed not only by general succession principles but also by the Constitution, applicable Ugandan laws, and recognised customs and traditions governing the institution. Therefore, the question of who succeeds to the Tooro throne cannot necessarily be determined solely by a private will. A court would have to consider the applicable law governing succession to the throne, including any legally recognised Tooro customary norms and traditions, and whether those customs are consistent with the Constitution and other laws of Uganda. For example, a person may express a wish in a will concerning the manner in which they should be buried, but that does not mean that a court is obliged to enforce every such wish if it conflicts with the law, public policy, practical considerations, or other legally recognised interests. Similarly, a provision in a will purporting to determine the holder of a traditional throne would have to be examined in light of the legal framework governing that institution rather than being treated in exactly the same manner as a bequest of personal property. Accordingly, if the late Omukama Oyo made a will expressing a preference for his son to succeed him, that provision should not automatically be treated as conclusive without first determining whether the will is legally valid and, more importantly, whether the succession to the Tooro throne i
