As a delivery driver, I only grab stuff when there is a sign making it clear that the treats are free for delivery drivers. Looking at that one sign I can understand why he was confused, but looking around it was obvious the home owner was selling those.

does it become guilty if you realize the accident but then choose not to try to correct it? like leave a grocery store with unpaid item on accident. I think it would become guilty because then you made the active decision to deprive them. here they did not. they fixed the issue.
