As a delivery driver, I only grab stuff when there is a sign making it clear that the treats are free for delivery drivers. Looking at that one sign I can understand why he was confused, but looking around it was obvious the home owner was selling those.

I think it would become guilty because then you made the active decision to deprive them. here they did not. they fixed the issue.
