This is bigger than “DEI.” The Civil Rights Act still exists, and intentional racial discrimination is still illegal. But since 2025, the Trump administration has been rolling back federal use of disparate-impact protections, a civil-rights tool used for decades to challenge certain policies that appear neutral but create unjustified racial disparities. Why does that matter? Because discrimination doesn’t always come with someone admitting, “I’m doing this because of your race.” Sometimes it’s hidden inside a school policy, lending system, housing requirement, employment test, or algorithm. A racial disparity alone does NOT automatically prove discrimination. But looking at patterns can reveal barriers worth investigating. This isn’t only about Black Americans. Depending on the civil-rights law involved, these protections can affect people across racial, color, and national-origin groups. A rule can look equal on paper and still deserve examination when its real-world effects aren’t equal.
