Suppose the suspect was beating the officer severely, trying to take the officer’s gun, choking him, or otherwise creating a reasonable belief that he posed a serious threat of death or serious bodily injury. Then the situation could be very different. Even if the suspect turns and runs, the officer could potentially have legal justification for deadly force if the threat remains sufficiently immediate and the statutory requirements are met.
