Ante la demanda de obligación de hacer, los vendedores se defendieron argumentando que en los contratos de compraventa no existía ninguna cláusula expresa que los obligara a sanear los lotes o realizar trámites de urbanización, pretendiendo trasladar la carga de la informalidad a los compradores. La Corte Suprema determina que la responsabilidad de una inmobiliaria o vendedor no se limita exclusivamente a lo que está escrito en el papel. Según el análisis, las obligaciones emanan de dos fuentes: la voluntad (contrato) y la soberanía estatal (ley).
