@um_kofi: FIFA Puts an End to Abusive Clauses: The New Article 17 Imposes Proportionality The FIFA Council Bureau approved on June 10, 2026, and the RFEF communicated it via its Circular No. 12, which relays FIFA Circular No. 1970, the reform of Article 17 of the Regulations on the Status and Transfer of Players, a direct consequence of the CJEU ruling in the Diarra case. What Changes? The new Art. 17.1 subjects termination clauses to a proportionality review: the agreed indemnity will be payable unless it proves manifestly excessive and unfair in light of the actual circumstances of the transaction (transfer cost, agreed salary, residual contract value).
