There’s nothing in the state of Massachusetts prohibiting this man from serving on a jury- the law is if you have a felony conviction older than seven years you can serve on a jury. If u have the felony conviction less than seven years ago you cannot or if you have a pending indictment for a felony charge you cannot- this man does not have a pending charge and was never convicted. And the defense and the prosecution definitely knew about this beforehand- they asked jurors questions in the court room. They also had the names of all the jurors. To do background checks. If the juror lied, he could be in a lot of trouble, but really it does not change the case at all. There was no verdict in the Clancy trial. Cannot appeal a mistrial - because there is no “final judgment”

They do have the questionnaires. They are saved. But I believe it would be really hard to prove the Prosecution knew about it even though I’m sure they did. I hope he goes after the double jeopardy & wins

I thought that the prosecutor and defense both had to agree on the jurors. Also, the judge should have allowed the juror to be released and altered with another one since the juror was not following the law.

The prosecution is not responsible to "vet" the jury pool. Both the Defense and Prosecution have the same information and same decision making power when it comes to the jury. Neither side has any more rights when it comes to the jury.

everyone keeps talking about the questionnaires as if the attorneys on both sides don't have the opportunity to ask them particular questions, along with the judge. a standard question that they should have been asked is whether or not the juror has any "life experiences" that would inhibit their ability to be unbiased - a fkn wife and child beater who is in severe debt OBVIOUSLY has experiences that would get him booted, so if he said no, he perjured himself - plain and simple. yes, a juror in Massachusetts can serve even if they have a restraining order out against them. that doesn't mean they can lie about bias while under oath.
