Depends on the state and which of 3 doctrines they use in their drainage law. Natural Flow or Reasonable Use and they might have a case. The Common Enemy Rule would likely leave them with no option except to build a berm on their side of the fence to block the runoff, with the one who paved their yard without much recourse if both neighbor's do it and their concrete yard floods into their own house.

Probably can’t sue but you can for sure report them to the planning and development permitting because of stormwater drainage requirements
