@i.a.n.network: Al-Rawi calls for police probe: ‘There’s been a confusion’ between minister and TTPS over truce and Medz Boss’ PDO revocation Opposition Senator and Senior Counsel Faris Al-Rawi is demanding answers from Homeland Security Minister Roger Alexander over his involvement in a publicly announced truce between two reputed gang figures and concerns surrounding the subsequent revocation of Preventive Detention Order of one of them. Al-Rawi raised the issue during a PNM press briefing on Thursday, September 10, saying what caused him “great alarm” was the apparent overlap between the minister’s role and functions traditionally carried out by the police. He pointed to a video posted by I.A.N News hours after Medz Boss was released in which Plumpy Boss said “Mr. Alexander, your Lego my brother (Medz Boss), you have kept your word, the peace is real,” as he called for K-Man to join him and Medz Boss. Al-Rawi said that statement was particularly troubling. “That is a very serious issue for us here in Trinidad and Tobago,” he said. He questioned whether a minister could make a commitment concerning the release of someone held under a PDO. “It cannot be a feature of proper law, due process, crime and criminality, or a state of emergency that a minister has given his word to release someone and cause their release.” With the State of Emergency nearing the end of its authorised period, Al-Rawi said the issue could become even more significant if large numbers of detainees are released. “The question is going to be, why were they detained in the first place?” He also questioned what would happen if detainees were never charged. “If there was a reasonable cause for that, who has been charged? Who is going to face the processes of having an explanation in court for the charges and a chance to acquit themselves?” Al-Rawi said he was particularly concerned about the possibility that the courts could eventually determine that some PDOs were improperly issued. “In the event that it is found out and demonstrated that improper actions have occurred in the issuance of preventative detention orders, who's going to stand the consequence?” He called directly on Alexander to explain his involvement and urged the Commissioner of Police to investigate whether the roles of the minister and police had become blurred. “I call upon the Commissioner of Police to commence an investigation into whether there has been a conflation of the offices and there's been a confusion and a pollution of the rules between Minister and Trinidad and Tobago Police Service.” Al-Rawi was also blunt about what he believes cannot happen under Trinidad and Tobago’s constitutional system. “It cannot ever be that the Minister of Homeland Security could have brokered the law that is not permitted in our system of law and under our Constitution.” He warned that the issue could ultimately become a costly legal battle for the State. “I'm confident that we can expect a swath of litigation, hundreds of persons to approach the courts of Trinidad and Tobago, and for there to be a cry for the payment of damages.” Al-Rawi pointed to the long-running legal proceedings involving senior policeman Earl Eli, who was detained under a PDO in 2011, as an illustration of how detention cases can remain before the courts for years.
