@shes_countrae: 🚨 GARY WAYNE SUTTON: DID HE ALREADY HAVE AN INTELLECTUAL-DISABILITY CLAIM? I've been digging through Gary Wayne Sutton's older court records, including Sutton v. Bell, because I wanted to know whether his intellectual disability was litigated before his current 2022 IDD petition. Here's what the records actually show. ⚖️ GARY'S INTELLECTUAL FUNCTIONING WAS AN ISSUE YEARS AGO. In his earlier litigation, psychologist Dr. Eric Engum evaluated Gary. The federal record discusses IQ scores of 77 and 83, described as within the borderline range of intellectual functioning. There was also evidence concerning limitations in social judgment, abstract reasoning, vocabulary and general knowledge, as well as allegations of neuropsychological impairment and brain damage. Most importantly, Gary argued in his federal habeas case that his significantly limited functioning and significant brain damage made executing him unconstitutional under the Eighth Amendment. The federal court rejected that argument. So Gary's intellectual functioning did NOT suddenly become an issue in 2022. It had been litigated years earlier. 🚨 BUT HERE'S THE IMPORTANT DISTINCTION: Evidence of low IQ, cognitive limitations or brain damage is NOT automatically the same thing as a court finding someone legally intellectually disabled and therefore ineligible for execution. Under Atkins v. Virginia, executing a person with intellectual disability violates the Eighth Amendment. So the real question isn't: “Were Gary's intellectual limitations previously litigated?” Yes. They were. The real question is: “Did a previous court actually adjudicate ON THE MERITS whether Gary met the legal definition of intellectual disability?” ⚖️ THEN CAME THE 2022 PETITION. In May 2022, Gary filed a petition under Tennessee Code §39-13-203(g)(1), asking the court to determine that he is intellectually disabled and therefore ineligible for execution. The District Attorney moved to dismiss it. The State's position is that Gary's intellectual-disability issue had already been adjudicated in earlier litigation and therefore his 2022 petition is procedurally barred. Tennessee law restricts use of this procedure when intellectual disability has previously been “adjudicated on the merits.” And this isn't social-media speculation. The Tennessee Court of Criminal Appeals' July 27, 2026 order specifically discusses this dispute and says both the District Attorney General and Tennessee Attorney General take the position that Gary's petition is procedurally barred. 🚨 BUT THIS IS CRITICAL: That July 27 appellate order did NOT rule that the State is correct about the procedural bar. It reported the State's position. It did not decide the underlying question of whether Gary's earlier litigation legally qualifies as an intellectual-disability determination “on the merits.” So here's what we can accurately say: ✅ Gary's IQ and intellectual limitations were litigated long before 2022. ✅ Gary previously argued that executing him given his limited functioning and brain damage violated the Eighth Amendment. ✅ The federal court rejected that argument. ✅ Gary filed a specific IDD petition in 2022. ✅ The State now says the issue was already adjudicated and cannot be brought again. ❗ What has NOT been established by the July 27 order is that the State is correct. That's the fight. There's a HUGE legal difference between: “A court previously considered evidence of Gary's intellectual limitations.” and “A court previously adjudicated Gary's intellectual disability on the merits.” With Gary's execution scheduled for December 3, 2026, that distinction could be incredibly important. I'm going to keep following the actual court documents rather than simply repeating either side's narrative.
