Yeah, it’s more common than people realize. My mom works in the prison system and I believe 1 in 4 rapes it from a CO.

Not only is it in the training they also tell you exactly what will happen if you do it. So you knew the consequences and still did it, I’m glad they made an example out of her.

You are considered to be in a position of power over the inmates. People don’t think its that serious because shes a woman and the inmate is male. If the sexes were reversed people would view it as rape and in a lot of cases it was rape. That’s why the laws are so tough. Not to mention it creates a huge security risk. The inmates basically owns her at that point.

Georgia law says consent is not a defense to improper sexual contact between certain employees and people in their custody. That does NOT mean you can determine someone’s legal sex-offender status simply by saying “inmates can’t consent.” Georgia has a separate statutory definition of “sexual offender” tied to the person’s conviction and whether that conviction triggers registration. Look at O.C.G.A. §§ 16-6-5.1 and 42-1-12. Words have legal definitions for a reason. I think what she did was wrong but it’s worth talking to an attorney to see if there’s a loophole. People make mistakes but that was a big one. ESPECIALLY because there’s children involved. I would move to a new country and start over. Very difficult to live life with that on your record.
