Hell no that’s money taken from his paycheck she has not put anything into his 401k that’s money that his employer puts in and what he puts into it so in my opinion she should not be allowed to receive any 401k money maybe child support if she has the kids if not then she should have to pay child support she apparently doesn’t have a 401k but she wants to take his that’s so wrong she hasn’t put one dollar into his money so she shouldn’t be able to touch his money

That’s why I was a father in that situation I would be fighting and spending all of that 401(k) money and all of that tax money will get full custody of my kids.

I think but I’m not sure and I’m sure it goes from state to state, but if I’m not mistaken, you have to be married more than two years to be entitled to half of 401(k) assets
