@pdavisjones: In a few weeks, the Supreme Court will consider whether or not they'll hear the case of John Reem, an engineer in Ohio who is a hobbyist home brewer. John also wanted to experiment with distilling whiskey but found that under current laws, that's punishable by imprisonment and fines. So, he sued, saying that he should have the right to experiment with whiskey distilling in his own home for personal and educational purposes. Initially, the Sixth Circuit Court of Appeals disagreed, saying that he would be engaging in a form of tax evasion because the whiskey he produced would not be taxable. However, earlier this year, another panel of judges ruled the ban on home distilling to be unconstitutional, arguing that the federal government does not have the authority to ban hobbies like this, particularly if they do not violate state laws. It looks like this disagreement between the Sixth Circuit and the Fifth Circuit lays the groundwork for a case the Supreme Court should hear. So, in this video, we're going to look at the merits of John's case, how it connects to the Commerce Clause, and how this all connects to a federal government that has become profoundly impactful in our daily lives—much to the disdain of many Americans. just to clear this up. him experimenting with whiskey in his house is no different than me baking cookies. I don't sell them, I give em away just like he'll probably have friends over on a weekend night to taste his whiskey and have a bbq. I live in a small farm town, I grew up canning peaches and making jelly to give away to the neighbors, if the government said no to that I'd also sue them.
