In 2018, an influencer sued PopSugar after alleging that her Instagram content was copied and republished without permission. The litigation expanded beyond one creator, with allegations involving content from thousands of influencers and claims including copyright infringement, removal of copyright-management information, false endorsement, right of publicity, interference with contract, and unfair competition. The broader litigation ultimately resulted in a $2.115 million class settlement. That does NOT mean one creator received $2.115 million, and PopSugar did not admit liability. But it illustrates why unauthorized commercial use of creator content can be a serious issue. If you’re a TikTok creator, Instagram creator, UGC creator, photographer, influencer, or other content creator and you discover a brand using your video, photo, likeness, or other original content without permission: DOCUMENT IT before it disappears. Save the ad. Screen-record it. Save the URL. Capture the account running it. And if it’s a Meta ad, look for it in the Meta Ad Library. If something like this has happened to you, DM me.
