The moment that buyer signs another BBA after being under contract with me is the moment they’re in breach of our BBA. So, what’s your take on that?

Yeah but if that LA doesn’t pay me I’m slapping them with an ethics complaint and arbitration. They’ll lose.

This ruling seems to have undermined the use of the BBA.

BBA are bs. As a buyer I will never sign one. This is rediculous that you are tied to one broker to find a home.

100%. If the buyer agent wont come to my listing and I have to go there and show the house myself, I say sure. But that buyer agent sure as hell isn't going to get 3% commission. I won't cut them out completely but when they send an offer my I will negotiate 1%, maybe 1.5% if the file is clean. Saves my seller thousands for me to open the door.

If this is true then the bba is useless

What a crazy world we live in. If I go to car lot A and begin working with a salesman to find me the perfect corvette, one that I’m dying to find, and he doesn’t find it for me. But then I go to car lot b, and holy crap, there it sits. No way in HE double hockey sticks should car lot b be required to share the commission of that 200k sale with car lot a. That would be just nuts. So in real estate….. WHATS THE DIFFERENCE!?

Wow so you could be working with the buyer for 3 months showed 10 houses and boom one visit to the open house there you have it no loyalty.

Seems like the BBA doesn't matter then, I know it has to be done, but it seems like it doesn't matter, you mentioned the courts know and of course seems we are putting it on the buyer and although most if not all my buyers are referrals they won't do it. But I feel for other agents. Just nagging! Love your info. thank you!

Would it be good to go a step further and to text or email the agent hosting the open house that your clients will be stopping by and that your represent them?

I was always under the impression (even before they were required) that if a buyer has a signed BBA they are off limits & already working with someone. I have zero interest in being that agent that poached a buyer! If that’s not the case, what’s the point of the BBA?

Yep. Need proof of procuring cause. I made lanyards and had my digital card printed with a QR code that once is scanned, allows the agent to have all of my contact info on it. They wear it to any open house and just have it scanned if they like it by who is hosting. It allows me to also get that agents info so I can reach out to them and collaborate

Do you think that applies to all jurisdictions in the country? We are in New York York…. Just curious if that’s Florida interpretation by the courts or un universal. Thank you. As always, excellent content.!!

Would you suggest this kind of verbiage in the BBA?

In NE, our BBA form with BHHS has one section that the buyers have to initial that specifically calls out that they have NOT signed a BBA with someone else. However doesn’t mean people
