Sabi ni Azcuna at ng 3 pang dating Chief Justices: “The Avelino case is not the perfect precedent... First, what was resolved in Avelino is the right number to constitute a quorum, not the right number to convict a respondent in an impeachment case” At: “It was decided on the basis of the 1935 Constitution where the wording involved was different. It involved quorum and the quorum requirement under the 1935 Constitution says majority of the Senate. It didn’t say all the members, yes, majority of the Senate” Ibig sabihin: Avelino = 1935 Constitution, ang nakasulat lang ay "majority of the Senate" — hindi "all members". Ang isyu noon ay legislative quorum lang, hindi impeachment court. “Whatever interpretation of that majority of the Senate for purposes of quorum is different from the two-thirds of all the members of the Senate required in impeachment cases” c) Sa impeachment naman: Dito iba ang bilang. Sabi sa Article XI, Section 3(6) ng 1987 Constitution: "No person shall be convicted without the concurrence of two-thirds of all the Members of the Senate." Sabi ni Azcuna: “I respectfully submit... that the reference in this provision is to all members. As long as they are members of the Senate, they constitute the denominator... because all means all” “The clause deliberately anchors the threshold to two-thirds of all the members of the Senate, not merely the two-thirds of a quorum present at trial” Kaya para kay Azcuna, kahit absent, nakakulong, o nagtatago ang senador — basta miyembro pa siya ng Senado, kasama siya sa bilang. Kaya 16 votes pa rin ang kailangan sa 24-member Senate para ma-convict. Ang tanging hindi na binibilang ay yung namatay, natanggal, o nag-resign. Dagdag pa niya, nasa Senado na kung papayagang bumoto ang senator-judge na hindi um-attend sa ilang hearing, dahil tribunal of record naman at may transcript. Buod sa tanong ni Escudero: Para makagawa ng business (ordinary session): 13 ang quorum sa 24 senators, pero puwedeng maging 12 lang kung may senador na wala sa coercive power ng Senado — ito yung teorya ng Avelino na ginamit ni Escudero. Pero para kay Azcuna: Hindi puwedeng gamitin ang Avelino logic para sa impeachment conviction.
