@thelegalqueen: Because divorce finances are not always as simple as you keep yours and I’ll keep mine. Pensions can be one of the biggest assets in a marriage – sometimes worth more than the House – and ignoring them could leave one person significantly worse off in retirement. Here’s what the court actually considers when dealing with pensions on divorce. #Divorce #PensionSharing #DivorceFinances #TheLegalQueen

So what would happen if there was no kids and one person in the marriage chose not to work ? surely then noones has been forced into not working through childcare and its been a choice.

What happens if one partner took over £50k of their pension in a drawdown at 55 and used it to pay off THEIR debts and buy THEMSELVES a car and has then just frittered away the rest BEFORE the divorce? Is that taken into account?

I hope it’s okay to ask here but my partner was locuming for half our marriage and he didn’t put anything into his pension. He could have, he chose not to! I’m so worried he comes after mine - it’s small but at least it grew over that time.

What if one party has retired for 10yrs and is claiming their pension and has had the lump sum. The other person who is younger is still working and won’t be able to claim their pension for another 5 years. Their contributions will have been less than the first persons due to earnings. Marriage has been over 20yrs.

Hmm..I paid in £200k, she paid in £45k. I had to transfer £114k to her so she had £165k, I have £85k.

The law on this is utterly broken. If we both had the same career so both paid the same amount into a pension for the duration of the marriage, why is he allowed to start drawing down on his pension, gamble all of his lump sum on greyhound racing, and then cost me money in legal fees to fight him gaining half of my pension because of his “needs”. At what point is the finance settlement of divorce going to be looked at and be made fair. It’s a joke
