Senior Minister K Shanmugam highlighted a specific case in the High Court last month where young offenders involved in scams were let off with lighter sentences. “The Court sentenced them to probation and community sentences instead of more deterrent sentences,” Shanmugam said in Parliament on Oct. 6. One case involved an 18-year-old who was offered S$800 to open a bank account, which was later used to open a second bank account. A 66-year-old victim then transferred almost S$200,000 to that account. Touching on the High Court’s decision, Shan said that one of its reasons that rehabiliation is “generally or presumptively” appropriate for young offenders actually “contradicts the approach set out in their sentencing advisory guidelines.” While it is understandable for the three judges to feel sympathy for the young offender before them, Shan said, he believes that leniency is not the way as it will result in many more Singaporeans falling victim, including senior citizens who may lose their entire life savings. “This was why Parliament took a tough approach in our recent rounds of amendments to the relevant legislation,” the senior minister added. We respect the Court's views, but we will give effect to the policy position I have outlined, and we will table legislation in Parliament soon. It will be quite express, and we will make clear that the position in Erzan (the case above) is not to be followed.” #mothershipparliament
