Realtors don’t get it. Until it gets them and they get an ethics complaint or they’re standing in front the real estate commission.

The Blunt Broker :
It’s standard practice to negotiate informally and then sign. Has been forever.

We do a ton of verbal in Chicago but goes on paper eventually. I haven’t seen a written counter offer in….well ever.

Things I see OFTEN:
1- Agents don’t know how to fill out a Counter Offer form.
2- Agents submitting Addendum #1 instead of a counter offer.
3- Sellers don’t understand the Counter Offer Form and refuse to initial the 13 pages of the offer.
It’s exhausting

In the future, do I need to specifically ask my realtor not to communicate such matters via email? And to keep them to verbal or text communications while feeling out possibilities ?

This is such GREAT and Important information! I have received 2 emails with this very “discussion” recently from 2 different agents. I have told them to put it in a contract with ALL the terms spelled out and I will be happy to share with the Sellwr!

Question? Do Florida Realtors or the seller have to disclose to the buyer that the house has asbestos siding prior to executing contract ? Any Florida laws applicable?

Just make sure when you send the counteroffer you modify Paragraph 3(a) so you’re not automatically giving the other party two days to accept it. You can shorten it to one day or, even better, put a specific date and time that the counter expires.
It sucks to send out a counter and then get a better offer while the first buyer still has an open counter they can accept. You can withdraw the counter before it’s accepted, but then you have to make sure the withdrawal is communicated before they accept it. Much cleaner to give them a reasonable but short deadline from the beginning.

If I’m asking you out, does it have to be an official document?

Email is so outdated for communication. Either text or verbal if it’s not on an actual counter offer.

I'm confused. the first part of this you said emails don't count. but then the second part, you mentioned that a party can become bound by a signature line in an email. how can a counter offer not be enforceable through email but a figurative offer on a property that includes a signature line be enforceable? if the counter offer had a signature line, would it be enforceable?

Define signature in an email. You mean cursive writing of my name or just typed out as most email signatures?

I always talk through first and then follow with contract. Going back and forth multiple times gets too messy and confusing. I like a clean contract without a hundred initials all over the place lol.

Brandon Ingram - Realtor® :
I could see negotiating via phone call, text, or email to hash out terms, but once you have a mutual agreement, it should be written up on official contract documents and signed by all parties to be contractually valid and protect your clients
