Surveillance footage obtained from McDonald's corroborated witness statements by showing Martinez pick up the juvenile, place the child on his lap, and later walk toward the exit while carrying the child before being confronted by one of the possible guardians. After being detained and advised of his Miranda Rights, Martinez admitted that the juvenile sat on his lap and that he got up and walked toward the exit with the child, claiming it was a joke. Based on the statements of five witnesses, Martinez's admission, and surveillance video evidence, there is probable cause to believe Jose Martinez knowingly restrained and attempted to remove the juvenile from the custody of the child's possible guardian without consent. Therefore, I believe probable cause exists that Jose Martinez committed the offense of Kidnapping in the Second Degree. What is kidnapping 2nd degree? Kidnapping, second degree, penalty. — 1. A person commits the offense of kidnapping in the second degree if he or she knowingly restrains another unlawfully and without consent so as to interfere substantially with his or her liberty and exposes him or her to a substantial risk of serious physical injury. 2. The offense of kidnapping in the second degree is a class D felony. Good work to the witnesses and to Neosho PD.
