@a.gift.not.a.burd: Turning 18 means more independence—but it also means parents no longer automatically have the legal authority to step in when something happens. A Power of Attorney and other essential estate planning documents can make sure the right people are able to help when it matters most. Don’t wait for an emergency to start planning. 📄❤️ Want to learn more about protecting yourself and your family? This is not true. I work in a hospital and as a mom or dad, you are the legal next of kin, paperwork or not, the doctors will need the legal next of kin to make decisions if your son can't make decisions for themselves. Now if they are of sound mind its your childs decision. You still have no say even with paperwork. The poa only kicks in when your adult child can't make decisions for themselves. Im sure the financial part is different but for healthcare this is not true. It always helps to have the poa paperwork to prove your relationship but its not necessary like she makes it sound

Not true but it is smart because if parents are divorced and parents dont agree, problems can occur.

do not do this unless your child specifically tells you that it is totally fine. do not force them into it. do not do any of that stuff. have a genuine conversation on why you want to do this and then when they get married give that power of attorney to their wife

This is actually not applicable, you are his next of kin until he gets married. You would in fact be the person that they will reach out to and they will talk to you.

You can even do this medically for your adult daughter let’s say if you don’t trust there spouse. You can make medical decisions not the husband. Their property may be community property including money but you can be legally responsible for their medical well being if they weren’t cognitive aware

False, every hospital that I’ve ever heard of will call next of kin if they’re not married. To be involved with medical decisions. Why do people try to get others to spend money that they may not have to get these papers that they don’t need

Trauma ICU nurse here. NOT true (at least in my state). Many states have laws for a health care proxy if no advance directive is signed. First going to the spouse, if no spouse, adult child, if no adult children...decisions go to the parents. This happens ALL the time, even when adult children/relatives live OUT of state.

To everyone who's given this woman, a negative comment about saying it's not true. Listen up. It depends on what state you're in. The way this world is going. We are starting to not be able to have control over our kids at all. some states, when they turn thirteen, you can't even look at their own health records. you need to start now. Having a power of returning over your kids as soon as they're born. Sadly, but true, I had to do this. And my daughter's all for it.

I need a p.o.a. for my son, how do I go about doing that? I've called around everywhere in my area and nobody can tell me where to even call to do it. I even called the courthouse.
