"You being the mother, you know, the matriarch, and having had the opportunity to see many times here in court, do you want me to accept the plea or do you don't?" the judge asked. "After discussion, it's — the plea will be rejected," she said. "Okay, I'm not going to take the plea then. And Mr. Vereen, you have the privilege if you want to move to disqualify me, but I will make a couple of rulings," Milian told Roberts' lawyer, Roderick Vereen. The judge said Roberts' "admission of guilt is inadmissible and invalid, and is removed from the record. It cannot be used as evidence against him in a trial." "He has a right to be tried and presumed innocent like anybody else would. And of course, he has a right to have a trial jury of his peers who will decide whether he's guilty or not guilty, and that's all I can do today," said Milian, who presides in Florida's 11th Circuit Court in Miami-Dade County. "I'm sorry I cannot give you any closure on the case. I bear full responsibility. Maybe I should have spoken with you all before the plea was even presented to me. But I was trying to accommodate all the parties, and obviously I accept full responsibility," he said. "Sorry your loss. Thank you," the judge told Russell's family. Vereen told the judge Roberts "advised me that he is asking that you be recused from the bench." "It's my privilege to grant him his rights as I would any other defendant, so I will do that. Mr. Roberts, good luck to you," Milian said. Roberts was an assistant principal at Miami Norland Senior High School, where Russell was a teacher and test administrator. Russell was 41 when she disappeared in May 2019. Russell and Roberts had known each other for 30 years, and Roberts was her children's godfather. #law #court #crime
