I’m still dying in the hill that if it’s left my bank account on or before due date that I can not be responsible for what happens to those funds after that point because there is nothing I can control. Find me a court that can prove onus is on me once those funds leave my possession.

It is crazy, we had over 50 in our practice. The AI doesn’t even stack up and is not correct in so many of the notices. They are not even cross checking with the individual’s super funds. Every call we have made to ATO the officers just recommend to just pay it because it is not going away.

And because it’s super payments, if the director refuses or ignores the letter the ATO will just convert to DPN (director penalty notice) and tie it to the director personally.

How can you fight the ATO. It’s exhausting (especially for the accountants). Small business are so busy with trying to keep up with everything (ie surviving)! ATO are ruthless and it’s criminal that business collect GST for them (for free) and then any debt gets charged at 11% cumulative interest.
