He could have gotten them in the water to. Bodies slam into stuff (debris, stuff floating etc) and get marked.

The grand Jury report has multiple witnesses say they saw him slip and fall on the boat. Onto his back and the back of his head hit the boat also

You don't need water in your lungs to drown. As for the back of his head, it's the blood trapped from laying on his back. When you die blood will pool along the back of the head, neck, and torso.
