A 2News investigation uncovered a conflict of interest in the case of Utah death row inmate Ralph Menzies, who is seeking clemency. One of the parole board’s pro tempore members, Bradley Rich, was previously Menzies’ attorney in the late 1970s, representing him in two criminal cases — including an aggravated robbery and a prison escape — long before Menzies committed murder in 1986. Rich, who claimed not to recall the case, was set to help decide Menzies’ clemency request. However, the Utah Board of Pardons and Parole was unaware of this past relationship until the investigative report surfaced. Upon being notified, the Board replaced Rich with another pro tempore member before any decisions were made, citing administrative rules that require recusal when impartiality might be questioned.
