Do you think Massachusetts prosecutors did enough to prove Lindsay Clancy should be held criminally responsible for killing her children based on the evidence presented so far? Clancy's lawyer, Kevin Reddington, argued prosecutors fell short in that regard after the Commonwealth rested its case Monday and asked Judge William Sullivan for a directed verdict of not guilty. That motion was ultimately denied. Before he began calling witnesses of his own, Reddington said the Commonwealth had failed to prove its case against Clancy, including that she was criminally responsible for her actions and that the killings were premeditated. Instead, Reddington argued the prosecution had only helped prove the defense's case: that Clancy was suffering from an extreme mental disturbance that was not properly treated and should not be held criminally responsible for the killings. Reddington also moved for the judge to reduce the first-degree murder charges against Clancy to second-degree murder based on the evidence presented so far. Plymouth Assistant District Attorney Jennifer Sprague didn't directly rebut Reddington's characterization of the evidence at that point, instead she raised a procedural issue. Sprague said precedent in earlier cases establishes that Reddington's motion for a directed verdict should be considered only after all witnesses have testified and all evidence has been presented by both the prosecution and the defense.
