Typically most pawn shop policies are two months before payment is due, and they (most of the time) call you before payment is due. He didn’t miss payments, he let it go

doesn't matter who owned it before the pawnshop. once the pawnshop owned it and sold it, the ownership is legally transferd to that buyer, regardless of history.

The problem is, brother doesn’t want to OP to have that guitar, mind you, he sold it to the business owner, knowing it would go up for sale. I'm always on the mentality that if you're given a gift it's yours to do what you want with it. and he sold it and gave up ownership. that's what he wanted to do. that was his right. but he has no right to ask for it back after he relinquished it
