A judge today granted a Florida man’s request to not be in the courtroom for his murder trial. Robert Kessler, 74, drew national attention on Monday when he told Judge Nick he'd plead guilty in exchange for a Philly cheesesteak, fries and 20-ounce Pepsi. Kessler was representing himself as of Monday, but he changed his mind this morning and his public defender, Maria Dunker, took back over his case. Dunker told the judge that Kessler wanted to waive his right to be present in court during trial, so Judge Nick Nazaretia asked him about his decision before allowing him to do so. (The man sitting next to Kessler is a court employee who was going to describe exhibits to him because he is nearly blind.) Nazaretia said Kessler will stay in a courthouse cell for the day and "I will probably bring you out at 1:30 to make sure you're still don't want to be here, and then tomorrow we can start staying at the jail." "Since you're already here today, you're going to stay here today, okay? And once we get done with you at lunch, and if you don't want to be here, we'll send you back. So we're talking about another two or three, four hours at the most, okay? But we're not going to send you back right this very moment. Okay? so we're going to see how things go and make sure you don't change your mind again at lunchtime, because you might. Okay? But starting tomorrow, we will address you via Zoom," said the judge, who presides in Florida’s 13th Judicial Circuit Court. Kessler is charged with second-degree murder and abuse of a body. He's accused of murdering 47-year-old Stephanie Crone-Overholts and dumping her dismembered remains into McKay Bay in November 2021. He first was declared incompetent for trial and housed in a psychiatric facility, but, after treatment, a judge ruled in March 2025 that he was now competent. #law #crime #court
