Unfortunately this is why many men and boys don’t like the “new” definition of r**e because they’ve probably gotten drunk with someone who may not had fought them off. You can easily find men who will say “well I was drunk too” or “well I didn’t force her to drink”. This is a common occurrence. Men only recognize the beating and violent r**e.

Minnesota had a similar law. It was finally changed after Gable Stevenson case. So sickening how many rapists have walked free due to these legal loopholes.

thank you for explaining the law. HOWEVER, if she explicitly said no, then why does her taking substances matter? because sober or not, she did say no. and coercion should be umbrella'd under SA, no? ugh i hate law technicalities that don't protect victims... 😭
