The judge in Lindsay Clancy's trial declared a mistrial at 2:23 p.m. Eastern time today in Massachusetts. The judge questioned the jurors individually at the bench, then instructed them on the defintion of reasonable doubt before telling them to continue deliberating. Jurors returned to the deliberation room today about 9:23 a.m. The judge announced at 11:30 a.m. that they sent another note saying, "It is with a heavy heart that we report we are unable to come to a unanimous decision, and will not be able to." Sullivan was going to declare a mistrial, but he gave defense attorney Kevin Reddington time to petition the Massachusetts Supreme Judicial Court to stop his decision. Reddington's petition to the court asked for an order "to inquire into the ability of the identified juror to apply the law" or 2) "prohibit the further deliberations of a juror identified by the jury as biased and refusing to follow the court's instruction on reasonable doubt unless and until the court determines by individual voir dire that the juror is willing and able to follow the court's instruction." The court rejected the request, and Judge Sullivan convened court at 2:20 p.m. Reddington earlier asked the judge to inquire whether jurors agreed on any counts (first-degree murder or second-degree murder with manslaughter as a lesser offense), but he declined. No one has said in court whether the majority of the jurors favor guilty or not guilty. People connected to Reddington say they favor not guilty, but Reddington said on camera he doesn't know. Clancy is still charged, and prosecutors can seek a second trial. Everyone is to meet again in Judge Sullivan's courtroom on Sept. 29.
