@meghannmcuniff: An attorney for a former Ohio church pastor and "American Idol" contestant accused of murdering his wife questioned a detective today about the decision not to test him for gunshot residue. Mike Morgan, a detective-sergeant with the Tipp City Police Department, said gunshot resident would appear on Caleb Flynn if what he says happened were true and he entered the room after an intruder shot his wife. Attorney L. Patrick Mulligan first asked about evidence in Caleb Flynn's phone that showed he was seeing with another woman, "but there was no identification of who committed this homicide, correct?", referring to then Feb. 16, 2026, shooting death of Flynn's wife, Ashley Flynn. "We were following the evidence that was, that we were collecting," Morgan said. "And I appreciate that, but if you would be kind enough to answer the question? That would be a 'yes' or a 'no,'" said Mulligan, founder of Moermond & Mulligan in Cincinnati. "We did not use his, the evidence from his phone, no, to determine the case," Morgan answered. "Okay, and the bottom line is Caleb was not tested for gunshot residue, correct?" Mulligan asked. "No, he was not," Morgan answered. "But he was asked to wash his hands, which would take away all the gunshot residue. Correct?" Mulligan asked. "That's — yes. Washing your hands can remove gunshot residue," Morgan answered. "Is there a reason why gunshot residue testing was not done as one of the first priorities when you arrived on scene?" Mulligan asked. "It was not done because we believe that with his timing, that he stated he only took four to six seconds to get in the bedroom. The gunshot residue would be there, present on his body, and we didn't want to rush to judgment and take him into custody that night," Morgan answered. "Okay. So the bottom line is, you voluntarily talked to him, and he was more than willing to do that. Correct?" Mulligan asked. "Yes," Morgan answered. "But you didn't even ask him if he would voluntarily submit to a gunshot residue test. So it has nothing to do with an arrest at 3 in the morning?" Mulligan asked. "No," Morgan answered. "You certainly had the right to ask him, 'Can we get your hands swabbed?'" Mulligan asked. "At that moment, we believe that gunshot residue would be present on his body due to the fact he ran in there four to six seconds after he heard the gunshot. Then it was discussed with BCI agent if we should try to collect the GSR, and it was also explained to me that my initial thought process was going to be correct that there would be gunshot residue present on him," Morgan answered. #law #court #crime
