His argument: * Exercise-band evidence was incomplete * DNA work was “woefully deficient” * Fingerprinting was “awfully deficient” * The investigation itself was so lacking that he said calling it an investigation was almost too generous * His conclusion: “There was no investigation.” And that matters for Rule 25 because the question is not whether the prosecution had a theory. The question is whether the Commonwealth had enough actual evidence to support a guilty verdict beyond a reasonable doubt. Red’s position? They didn’t. Too many forensic gaps.
