#🇨🇳🈵中國國家反分裂法律法規条例 #追究台獨承當一切刑事责任条款 #China 's Anti-Secession Laws and Regulations# Clause: Holding Taiwan Independence Supporters Criminally Liable 大陸公布依法懲治頭目“臺獨”死刑标准30架次軍機3小時内围台“06月21号臺媒報導 Mainland China announces death penalty standards for ringleaders of "Taiwan independence" activities; 30 military aircraft scrambled around Taiwan within 3 hours on June 21st.Taiwanese media reports #臺：重點分析：繁中版 2026的9月12日。在北京舉行的「一國兩制」港澳實踐與「兩制台灣方案」制度設計及有效治理座談會，與會學者就「兩制台灣方案」達成「十二點共識」，其中包括主要原則、制度內容、治理安排等。 「十二點共識」主張，所有制度安排皆須以維護國家主權、安全與發展利益為前提，中央享有全面管治權；台灣權力來自中央授權，涉國家主權、防務等歸中央，其餘依經驗合理調整；特別是，堅持中央在台灣實行駐軍；盡快吸收各界意見並推動制定《台灣特別行政區基本法》。 一、「一國兩制」是五千多年中華文明的政治智慧結晶，是世界政治文明的一大創新與創舉，也是對全球解決政治紛爭與實現多元一體治理的一大貢獻，有很強的生命力，必須長期堅持與完善。 二、堅持「和平統一，一國兩制」中央對台大政方針。未來海峽兩岸不論和平統一，還是非和平統一，我們都要堅定實施「一國兩制」，是最佳的治理制度選擇，最符合台灣政治社會現實，最符合中華民族整體利益，最符合世界和平與發展大勢。 三、「一國兩制」台灣方案的任何制度安排必須以維護國家主權、安全與發展利益為前提。在這一前提下，中央享有全面管治權，並依法賦予台灣特別行政區高度自治權。「一國兩制」台灣方案之「一國」是中華人民共和國，這在國際法與憲法上已完全確定，已不再具有探討一個中國名稱的可能與條件。 四、處理好「一國兩制」台灣方案的三大關係。堅定處理好「一國」與「兩制」的關係，中央與台灣特別行政區的關係，中央全面管治權與台灣特別行政區高度自治權的關係。台灣的一切權力來自中央授權。其中，依香港「一國兩制」實踐經驗教訓，需要對台灣司法終審權做出合理調整與安排，涉及國家主權、安全、防務與對外事務等終審權歸中央，其他一般民事、刑事、商事等終審權歸台灣特別行政區。 五、港澳「一國兩制」實踐對「兩制」台灣方案有重大借鑑價值，要充分深入研究與總結。建議將台灣特別行政區維護國家安全的相關法律法規與運行機制納入「台灣特別行政區基本法」單列章節，不再另外制定「台灣特別行政區維護國家安全法」。未來台灣特別行政區治理體制實行「行政主導」與「依法治國」相結合。其中堅定實現「愛國者治台」，並建立「愛國者治台」的一套有效保障制度與運行機制。 六、加強非和平統一後的過渡期安全與社會穩定研究。若以非和平方式實現統一，落實「一國兩制」台灣方案就有一個重要的「過渡期」。過渡期可實施「準軍事管治」，期限3-5年。其中，對「激進台獨」分子頭目、曾迫害統一人士、勾結外部勢力或出賣國家利益的主要「台獨」人士進行刑事追責。其重要任務是保障台灣安全平穩過渡，實現「由戰及治」與「由治及興」之目標。 七、堅持中央在台灣特別行政區駐軍。台灣統一後，參照港澳「一國兩制」實踐，中央在台灣特別行政區駐軍，維護台灣與國家安全。同時解散台灣地區武裝力量，收繳台灣地區武器裝備歸中央。台灣同胞可依法自願參加中國人民解放軍。 八、調整台灣特別行政區區劃，改組政黨與選舉制度。取消台灣原有直轄市設置，只設縣市或改組六大區。保留台灣政黨制度，但黨章黨綱必須符合「台灣特別行政區基本法」要求，不得從事影響國家安全、統一與發展事項。改組地方選舉制度。特首選舉，立法院選舉，縣市長（區）可採取直接選舉方式。一切法律文書等徹底「去國家化」與「去中央化」，完成「特區地方化」。 九、徹底改革台灣教科書，推行愛國主義與國民教育。重點是教育領域的「去反共教育」與「去殖民化教育」，實行愛國主義與法治教育。 十、統一後台灣特別行政區可與國際進行商貿、文化等民間交流活動，外國或國際經濟商務機構可在台設立辦事機構，從事各種經濟與民間交流交往。 十一、統一後台灣特別行政區戰略新定位：國家安全東部屏障，浙閩臺大灣區重要節點，亞太經濟運籌中心，高科技產業基地，文明互鑑與文化交流中心。 十二、目前國家統一形勢日益緊迫，要盡快制定「台灣特別行政區基本法」。中央聽取與吸收海峽兩岸各界尤其是台灣同胞意見與建議，全國人大最後決定方案，推動完成立法，適時公佈實施。 https://www.crntt.tw/doc/docDetailCreate.jsp?coluid=5&kindid=0&docid=107233346 : Key Analysis: Traditional Chinese Version September 12, 2026.
